  1. It is too late to resolve this fairly, but I at least want the rest of my deposit back ($375) + reimbursement for having to file a complaint to get it ($35).

COMPLAINT DETAILS (from renter)

This problem started with the property manager, Jason Queen. In September '09, our basement flooded & the sump pump was not working, he said he couldn't get anybody out there for 2-3 days. 2-3 days went & no one ever came. We complained about the sump pump repeatedly & then the flooding caused mold. My child got sick in November. They thought she had a bad virus, but when it didn't go away, they thought she might have Mono. She didn't have Mono, but she started passing out & they thought it may be a blood sugar problem, but that test was negative. After this they felt she may have a heart problem, but after seeing a pediatric cardiologist, her heart checked out fine. It was then they they started to suspect something environmental & we discovered that it was the mold. Between respitory illnesses, our daughter's illnesses & all that went with that (Lost wages & I had to drop out of graduate school) we have bills of about $30,000. When we found out about the mold causing our child's health problems, we immediately let the agency know that we were going to start looking for another house because of the mold. Lisa stated that this was fine as the house, which had also been put on the market, was going into quick sale. She even offered to help us find a house & sent listings. The bank did not approve the short sale & she said that we would have to stay in the lease. We said fine, if you remedy the problem, but the problem was never remedied. No one ever even came by to assess the problem. We decided to purchase a home, but did not sign a contract until we had given the agency an additional month to remedy the situation. Not only did they refuse to fix it, but they refused to let us out of our lease & threatened to sue us for the rest of the rent & their attorney fees. We left after sending a certified letter making a final attempt to get them to fix the problem (as SC law requires), but they do not even have the decency to give us our deposit back. Lisa finally agreed to give half of it back, but when I asked for the rest, she lied & said that my husband had signed a release, when I know that he did not. I have a lawyer that will take the case on contingency, but my family has been through so much that I don't want to add the stress of a law suit. However, they can at least give us our deposit back & I want there to be records of what happened to make it harder for them to do this to someone else.
