This is the letter left on my table by Tammy Wright while I was not at home on Sunday August 25th 2010. I received no notice at all that she was coming and by law she is required to give me 24hrs notice, not only did she trespass but she left the front doors wide open and all my lights on with my animals left unattended as well as my personal belongings. The point of this is she is now saying we owe $6000.00 when 12 days ago she was saying we owe $3049.48. I reminded Tammy of the two separate times I had given her cash ( $550.00 and $496.00) that were not included in her hand written receipts but that she clearly remembered. I also brought to her attention that there are quite a few mistakes in her receipts for instance in May she charged me $1200.00 and then a few weeks later there is another receipt that she added in another half a months rent for May that she had already charged me $1200.00 she also added in $238;00 for the water/sewer bill and stated that it was included in the balance and then a few weeks later on a different receipt charged me again. She has admitted to making mistakes in her receipts including and not limited to to cash this includes money orders that she never seems to have record of. She told me yesterday that she deposited the $300.00 money order and two checks totaling $1500.00 when I had already told her I was canceling them because she said she could not find them.. her exact words were "I found them.. they were mysteriously in my mailbox on August 27th 2010"

This is the heat control ..the furnace has not been serviced since I have lived here, in the winter the furnace kicks on for a minute and shuts off ..the pilot (flame) blows out sometimes 5-6 times a day.

Living Room Ceiling .. This was starting to collapse and the only thing done to fix it was a few screws put in ..the plaster still falls and is not safe.

This is a picture of the water heater that Tammy herself came out 5 months ago and took pictures of and informed me that because I owed her rent she was not going to fix it. She was made aware by myself over the phone, in person and in writing.

COMPLAINT DETAILS (from renter)

Upon first inspection of the unit there were water stains on the master bedroom ceiling and I was assured by Tammy Wright that the stains were old ..she had promised to change the tiles. Approximately 6 months after living here we noticed that the ceiling was starting to leak ..we informed Mrs Wright and the battle began, certified letters have been sent pleading with her to fix the problem. I informed Tammy that we could smell mold and my family was starting to have health issues. We also did a self mold test and payed to have it sent out. I showed Tammy Wright in person the positive mold results only to be told that she did not care about that she just wanted her money. We have had the town inspector here and a band aid was put over the problem we have been sending letters for 2 years and today on this day we (August 25th 2010) are sitting here with buckets in the bedroom and have taken video documentation. We have also had the gas company, fire department and servpro here concerning gas and electrical problems, MOST important the gas pipe coming From the water heater is not lined up and could be leaking gasses I sent Tammy a letter certified notifying her of the emergency and she has done nothing. We have also informed her that there is one screen in the entire unit (with holes) and bugs are a major concern as well as both front and back doors are broken and do not stay closed. Again nothing done. I called Tammy on Saturday August 21st 2010 to tell her that we had a 2ft snake in the kitchen we still have no screens and broken doors ..an argument occurred and I informed her that I was calling the state. The next night on Sunday August 22 2010 she came into the unit without permission or notice while no-one was home and left a letter on my kitchen table stating she was going to start the eviction process.

I called you from my mothers and you said they were not there a week after I dropped them off? I told you I would call you right back I called to check the status of the money order and I told you I was going to have to cancel them bu it could take anywhere from 30-45 days to get my refund from the money order ..stop calling me a liar!!!! I told you I had to do it on my computer and I even called you again the next day to give you the opportunity to try and find them before I canceled them. I was on the phone with you when you went to someone and asked them if they got your mail and they said no. You never called me to tell me you found them you said "they myseriously appeared in your mailbox on the 27th after you were told they were canceled. You didn't tell me you found them you only told me long after the fact that, you tried to deposit them and according to your receipts you deducted them on the 26th from my balance and later added them back in. I told you I would pay what is owed ONLY I owe you $2400 for August and now September that is what I agree to. Please let me know in writing if you are going to accept that and again I read you off check numbers and also offered to send copys of the cashed checks dating back as far as you would like, you did tell me as we were going through them that you did not have record of a few of the payments including the cash in May and check # 160. I need to know right away what you want to do because as I explained my son is having MAJOR surgery the first week in November and I need him to be able to come home to recover for 2 months in a clean safe home.

Renter Sep 8, 2010 66.30.83.149 She is correct when she states that I said I was not paying "fee's" she is trying to charge me $150.00 for 2 checks and a money order I canceled because she told me she LOST THEM!! If you had intentions on working things out why did I get served by the police last night???. This situation has become VERY overwhelming

I will see you in court". I told Jennifer that I would go over all of my accounting records and would correct any errors. It is taking some time and am still working on it but so far I have found where you paid $550 in cash on 5/1/10 and have deducted that from your account. I have not found where you have been charged twice for the water bill and the month of August but please give me a chance to complete the review. Several days ago when we spoke you gave me the impression that you have no intention of paying in full and have no intention of paying ANY late fee's or bad check fees at all. When we have conversations you threaten to not pay me at all if I go forward with the eviction process. You have given me no choice to do otherwise. The $1500 amount that is on the papers you were apparently served with today is not the FULL amount that you owe. My calculations so far show a balance of $5227.28. But like I said, I am still going through the account and plan on mailing you all the receipts for you to review and we can still work on any discrepancies if there are any at that time.

Renter Sep 7, 2010 66.30.83.149 I am at a loss right now I was just served an eviction notice by the Seabrook Police saying I I have to appear in court by September 16th 2010 due to rent owed in the amount of $1500.00. The contractor came out yesterday and looked at what work needs to be done.

Landlord Sep 7, 2010 67.239.15.230 I spoke with the carpenter this morning. He stated that he met with Jennifer yesterday. He plans on starting the job this week. I left a message for the plumber on Sept. 5 informing him that Jennifer plans on being available all this week after noon. Asked him to please try to fit her in this week. Awaiting his reply. An electrician was also called my myself this afternnon to see if he can address the minor wiring issue on the front porch. Awaiting his return call as I got his voicemail.

Renter Sep 5, 2010 66.30.83.149 I just spoke with Tammy and we went over our records. I show a balance including September of $1754.00 there were a few payments that were missed ( Payments in May and June 3 checks and one cash transaction I have printed checks and a hand written receipt from Tammy for the cash.) they were not deducted from my balance so check numbers have been given to Tammy to go back and look over. I also gave her receipt numbers (from her handwritten receipts) where extra months were added, in May 2010 1/2 a month was added where it had already been added also in August the rent was added to total balance and then added again in a receipt 7 days later and the water/sewer bill was also added twice. The call was normal and the tone was neutral. Tammy informed me that she was going to call the carpenter and plumber again today and set up something for this week I told her I was going to be home all week and the first available appointment would be appreciated..

I told you last we talked I am here at any time you told me to call the carpenter to set up a day he can come out . I called him Thursday September 2nd and asked him to please call and let me know when he can come out. There are no lies going on from me here. I received the receipts you left in my mailbox and i'm not sure where your coming up with your figures but you are VERY mistaken. I am not paying you for checks I canceled because you said you lost them, you are trying to charge me $50.00 each check I canceled. Plus you charged me AGAIN for August rent twice!!! I have all your receipts and my statements.

I spoke to Tammy at roughly 6:00pm the SAME day and called the contractor myself approximately 5 minutes after speaking with her and left him a message asking for him to please call me as soon as possible. My answering machine is clear and I received no phone calls today. Tammy's back rent total has now doubled it's becoming more obvious that this is a matter for the courts.

Landlord Sep 3, 2010 24.60.76.62 There have been several visits by Leonard Beauvais(carpenter) addressing/fixing the master bedroom roof, back door of master bedroom and the interior. Cullen Mutrie(carpenter) has been there to repair back steps/rails, replace master ceiling bedroom tiles, check for leaks/mold. No leaks or mold was present. Repair living room ceiling. tiles were replaced. He fixed a window in the rear of the master bedroom. These were in response to her letters. The major problem is many many many times in the past she uses her caller ID and does not answer her phone when I call and I am unable to leave a message so when it is very important that I reach her I will keep redialing and she then picks up. She screams and yells and threatens then makes it extremely difficult for the contractors to get in. I am convinced this is all a ploy to make me look bad and give her as long as possible to avoid paying her rent. She is more than $6000.00 behind. I have mailed the remaining receipts to her for her review and asked her to compare her records with mine so we can work out a payment plan. She told me she was going to be home all day yesterday so that is why I asked the plumber to call her then. She is doing her best to delay this process. She can make all the claims she wants but the bottom line is Ithe contractors have tried to reach her and have been unable to do so. I need her COOPERATION to get this done ASAP

Renter Sep 2, 2010 66.30.83.149 This is the exact reason this has gotten as ugly as it has no matter WHEN I ask for the same things to be fixed over and over again. I get alot of bitterness and I am not going on with this any longer .I am done with the bickering as I have told Tammy MANY times I have taken the necessary steps to protect myself and my family with documentation along the way I have nothing to hide and have done nothing but be truthful with her. I am a good person and I take care of my responsibilities. I have rights too and I feel that I am being treated VERY unfaily. I will report to the agent only any and all future responses.

Renter Sep 2, 2010 66.30.83.149 I received a phone call from Tammy Wright this evening at about 5:45pm. She told me that the carpenter had called me this morning and I explained I was not home. I promptly asked for the number to call and make arrangements. the phone call was hostile as it always is Tammy said "I told you to clear your answering machine" .. she can be extremely rude with her tone thus causing arguments. I called Mr Locke immediately after hanging up the phone and left a message on his voice mail to please call me to make arrangements. Mrs Wright is trying to make this out to be my fault any way possible. All I have asked her to do is fix the potentially dangerous and unsafe/livable conditions. I don't think asking for it to not rain in my bedroom is asking too much. And the pipe that is not leaking gas as she says but it's more of an exhaust and none the less told by the gas company it could be dangerous if left unfixed. and the other issues listed. The only time phone calls are avoided are when they are harassing 15-20 times in a row as my phone records will show. I'm asking for these repairs i'm not going to turn away the people that are coming to help.

I explained that he was unable to leave a message as to his availability and asked if she would clear her full voicemail box and she said "you are not my boss". She has been given the phone number of the plumber and carpenter and states will be calling them. I also advised her to clear all of her personal belongings out of the Master bedroom to protect them from any leaking especially since we are expecting very stormy weather from a hurricane late tomorrow. She stated she would, but not sure about her bed. I said she needs to take reasonable care to avoid her belongings from becoming damaged until the carpenter can be scheduled to come in.

Landlord Sep 2, 2010 24.60.76.62 Jennifer and I spoke yesterday. I told her the name's of the contractors who will be calling to get in to make necessary repairs. I also said she needs to please answer the calls and please clear her voicemail box so when they call and she doesn't answer, they can leave a message. 10:19 this morning I received a call from the licensed plumber Jerry Locke of Locke and Son's plumbing. He called the phone number that I gave him to contact Jennifer and thought the phone number was wrong because no one picked up and the outgoing message he heard was "the mailbox for Gianna Tuscano is full" and was unable to leave a message. I explained to him that the number I gave him was correct. and apologized for inconveniencing him. I am ebarrassed really because thse contractors are busy and do not have time to play these games. I called Jennifers house at 10:23 am and got the same outgoing message and was unable to leave a message to let her know that the plumber is trying to make an appointment to get in.

Renter Sep 1, 2010 66.30.83.149 In Tammys response she is doing exactly what she has been doing to me for almost 4 years she is stating that I never told her about any of the issues and she is also saying that I avoided her attempts to fix them. I have letters dated from January 2008 asking her to fix things and at the time the most important issue was the badly leaking roof and the mold. I started asking for the repairs to be addressed in January of 2008 certified letters will prove this. The Gas Company told me about the gas pipe and Tammy herself came and took pictures 5 months ago.I am going to make a list of the repairs that need immediate attention and Tammy and I have just agreed to go over the balance of rent in question. 09/01/10

Landlord Aug 31, 2010 24.60.76.62 All I can say is that I have every intention of fixing what ever needs to be done. However, Jennifer needs to let me know that there is a problem so I can do so. Jennifer also needs to answer her phone or clear her voice mailbox so when the repair person calls he can leave a message to schedule a time to come in. One time it took months to get in touch with her to schedule the carpenter to come in. Jennifer promised retaliation ( I have the saved phone message to prove it) right after she was aware of the demand for rent notice. I look forward to seeing her in court and I will bring the witnesses with me to verify everything that has transpired. Jennifer can make all the claims she wants at this time, but I cannot arrange to fix what I have not been made aware of. I have already contacted a plumber and carpenter to go in and take a look to see what repairs need to be done. Clay Fowler of the Seabrook Fire department can verify that he went to the property because Jennifer falsely claimed that she had a gas leak. There was no gas leak present. He also informed her that she was overloading an electrical socket. She tried to claim that there was a problem with that as well. I have the proof that Jennifer has a history of making claims/complaints that do not surface until she becomes quite far behind on her rent. I have other professional statements as well, but prefer to bring them before a judge if that becomes necessary. Be careful with this one, she is very vindictive. The demand for rent was executed and delivered on 8/23. I see she contacted your company on the 27th. She was also given a letter by me asking her to please contact me with a time to come in and view the premises. She has yet to do this. I look forward to resolving this matter as quickly as possible, but need Jennifer's cooperation to do so.
