COMPLAINT : Continual leaking roof
Fair Resolution according to renter :
  1. Get roof repaired so doesn't destroy my property. Reimburse for RPA fees and property loss.
  2. Additional complaint: Continual wetness has major mold in bathroom
  3. Additional complaint: Loud neighbors, banging and hammering at midnight and later, Dogs barking all weekend long
  4. Additional complaint: Beer drinking, partying, and smoking on my front porch - I am sensitive to smoke, fragrances, etc.

COMPLAINT DETAILS (from renter)

Roof leak had to be fixed when I moved in 28 years ago. Landlords have changed several times. Finally got cooler leak fixed last year 2009 after over 10 years with problem. I threatened to send all my heat bills to him under the ceiling in the hallway around the cooler got replaced. WAs done within 2 weeks.No one should have to live like this. Adult sons can give details of this on-going for years before they left home. Water damage in past destroyed, books, clothing, linens, etc. Takes forever to get appliances replaced as well. Outside stair railing is broken, hanging loose and has not been welded.

Renter Dec 18, 2010 174.27.130.72 Amount of rent should still be lowered. Comparable one bedroom apartments in area range from $295 to $365. All have more features that I currently experience. Most have dishwashers, I don't. Most have attached garages, this has carport quite a few feet from entrances. All have washer and dryer hookups. The plumbing in my aprtment is screwed up and have never been able to install a washer or dryer. Others have safe secure dry environments. I still have leaking roof, mold in the bathroom, railing coming stairs into the apartment is still loose and unsecured. More than 75% have A/C. Have old, squeaky and leaking swamp cooler. Many of them include utilities. Doug covers Smithfield City sewer, water and garbabe pickup, now. Was added to rent amount over two years ago now. I still pay for gas and electric. I have shut the heating vent in the back bedroom. Put blankets over it, to keep the heat out. Closed the drapes and have put towels and blankets in the hallway outside the door to keep the cold air from coming into the rest of the apartment. My heating costs have still gone up considerably. It has been cold, but I feel I am paying for the heat to go out the roof, which is out of my control. Normal is about $30 per month. Last bill was $65. Ideally would would like rent lowered to $300 from now until roof is fixed, I can get accepted at another complex or after May 2011 when the weather warms up. Was never approached, called or otherwise contacted by landlord to have discussion of this situation. Have not asked for reimbusement for items lost due to previous leaks, to reimburse for filing fee or anything. Had to ask twice about reducing December rent's due to the roof collasping before the middle of November when I had paid the full rent. Thank you so very much for your help in this matter. It has been beyond frustrating and aggravating. Don't anticipate the landlord doing anything further. I did sign to accept the rent at $350 so I don't know if a reduction is possible. Just tried to compare options, current rentals and suggest that a further slight rent reduction seems to be justified. Realize he can't do anything about the neighbors, dogs, their smoking, etc. Could suggest that they keep a certain distance from the buildings when doing so, as city ordinances state.

Agent Dec 20, 2010 LANDLORD UNWILLING: Landlord is unwilling to come to a solution to this complaint. The tenant has purposed their fair settlement offer to resolve this complaint. The landlord has refused to accept their offer and has not presented an alternative solution. Agent has no choice but to close this case. A fair resolution cannot be reached through mediation alone.

Agent Dec 15, 2010 FINAL RESPONSE PERIOD: Agent is providing both parties with 1 week to create final statements. Agent will review statements to determine if further mediation is applicable.

Agent Dec 15, 2010 CASE PENDING: It appears the case is now resolved. The tenant still states that the dog has been barking which has not been addressed by the landlord. The agent will allow 1 final week for new responses to determine if further mediation is needed.

Agent Dec 9, 2010 REQUEST FOR FAIR SETTLEMENT: It is clear that both parties feel that they are justified in their arguments. However, if we are to resolve this complaint through mediation, we will need to find a fair solution that both parties can agree on. The agent is asking that both parties reconsider their stances and offer a solution that will be fair to all involded. The agent will allow both the tenant and landlord one week to make an offer that would be acceptable. The agent will review the offers to determine if further mediation is applicable. It is the agents hope that both parties will reach an agreement through mediation. Pending one week response period...
