last conversation 11/17/10 chuck texted me at 4:20:57 pm. one hour and 40 minutes before i got off work. tara im coming over to inspect the house again, in a little i texted him back at 4:26:42 we would appreciate 24 hours notice before you show up. sandra and chuck showed up before 5:39, kelly called me and told me. i told him that he did not have to let them in. he let them look around the house and they left around 5:45 as kelly was leaving for work. i texted sandra at 5:48:46 i asked chuck to give us 24 hours notice. next time i will be there with my lawyer bill fleischaker and the police. she texted me back at 6:16:25 we can come by anytime 2 check on the property as long as we notify u. and u can talk to mine... Genesio i texted her back at 6:41:28 as i was driving home from work and could not reply quicker that was not part of our verbal agreement. you did not have my permission. she responded at 6:51:46 i dont have to have your permission. i just have to notify you we are coming to inspect/look the house over. that is even per my attorney. i started recording the conversation at this point. i texted at 7:18:56 you do need my permission. you did not come by to repair anything and you also did not let me know in a timely manner. i was at work and unavailable at the time. unless you have my explicit permission, you and chuck are not to be in the house without me present. she responded at 7:24:38 i do not have to have your permission. it is my house. all i have to do i notify you. i am done with this conversation. i did not respond. will be consulting with howie lindeman and alesha gilleland on 11/18/10.

Landlord Dec 11, 2010 69.152.64.85 How am I as a landlord supposed to keep the property in upkeep properly as I am suposed to if I am not allowed to even stop by to ask about rent or fix something on the outside. We cannot get them to answer the door when we do stop by and they do not answer the phone calls so I do have to resort to texting them to even get an answer. I am only trying to make sure my house does not get any damage by normal wear and tear that could be fixed before the problem gets worse. If I am not notified and have to wait for the tenant to notify me and they do not are they then responsible if it could have been prevented by repairing it when it first needed it?

Landlord Dec 11, 2010 69.152.64.85 I had my husband stop by on the 10th of december to inquire about the rest of the rent that was due and he did knock, both vehicles were home and no one answered the door. He noticed that the screen was off of the window again and had every right to fix it while he was there so the dogs would not tear it up. I have agreed to give a 24 hour notice before we inspect the house to the tenant and will continue to do so. If something needs repaired on the outside and I am not notified we have every right to fix it, it was not intruding upon the renter. As far as the text messages go they are relevant seeing as Kelly Gilleland is her roommate and when they entered into the contract he was also mentioned. I have given them way more than 30days to vacate the premises and again that was given in November on the 10th as I previously mentioned. If by December 31st they are not out this will go to to my lawyer to handle. I have done eveything to accomadate the tenant and can still not get rent on time.

Renter Dec 10, 2010 72.24.206.160 Also, the landlords husband, Chuck, came by the house unannounced today. This is a violation of the previous agreement. He entered the backyard to fix the screen, and our dogs almost got out. Seeing as Kelly was the only person home, this is extremely frustrating to me. I would appreciate if the only communication is between myself and Sandra. And if anything needs to be fixed, we will either notify Sandra, or she will let us know in advance when she plans to fix it.

Renter Dec 10, 2010 72.24.206.160 I do not believe that these text messages should be relevant at all. I, Tara Nelson, am the tenant, the agreement is between myself and Sandra. I am not responsible for any actions taken by other parties. The verbal agreement was that we had a year, and at the end of the year, Sandra told me i had til August, in a written letter. I believed that she would understand my predicament when i had to wait two days till i got paid to pay rent, as she told me early on, that she would be flexible due to my current situation. We are struggling at the moment to pay our bills and rent. Add to that, we are being kicked out in the middle of winter, with no place to go at the current point in time. Im trying to make this as easy and painless for myself as possible, as i am solely responsible for everything in this juncture. We are planning on being out by the 24th. If that is not possible we will make sure the the landlord is notified.

Landlord Nov 29, 2010 72.24.208.69 I have always given the tenant their privacy and will continue to do so, the inspection of the property was never meant to intrude on privacy but to maintain that no damages had been done further.

Landlord Nov 29, 2010 72.24.208.69 I am not willing to reimburse for RPA fees due. I am willing to give a 24 hour notice before arriving/visiting the property. If anyone is due an apology it would be due to the landlord from the tenat. This has all came from the fact that on November 10th 2010 I gave them notice that they had to be moved out by December 31 2010 due to the inability to pay rent on time. I have several text messages from Kelly Gilleland on November 12th, 2010 that started coming in at 10:27 pm at night until 11 pm at night that were very rude. Also due to the fact that we have had several disagreements on the way they have maintained the property. I have had to consult with an attorney due to these issues.
