COMPLAINT : Financial Hardship Breaking Lease 2 Months Early
Fair Resolution according to renter :
  1. Paid for December. Let me out of my lease for Jan and Feb. Lease ends Feb 28th
  2. Pay reduced penalty: Did not give me Pet Rider and hot water/lock issues with unit
  3. Keep $300 deposit and let me out of lease due to never disclosing Pet Rider or additional fees
  4. Negotiate payment plan were I can afford to move into cheaper housing AND pay them
  5. Utilize my rights/law to have them sublet apartment even though says can't in lease.

COMPLAINT DETAILS (from renter)

I moved to MA from CT for a job after being unemployed for a year and a half (was divorced, lost job and filed bankruptcy). Had two weeks to get here and start working. I have a dog and a cat. Trying to find a place to live in MA that takes pets was difficult due to being in CT. Ended up at Cloverleaf and have been struggling to pay $1408 a month on my weekly take home of $935. Have borrowed money from parents and am in good standing with Cloverleaf rent wise. My company is moving from Natick to Westborough MA and I have found a cheaper unit closer to the new location: $1100 w all utilities included. Current unit at $1408 is just heat and HW. Never had me sign the Pet Rider on my lease or fill out ANY information on my animals. Saying that I FAILED to provide them with info that I had pets. It is a one time $300 non-refundable or $50 per animal added to rent. I have 2 pets. Gave me Pet Rider on the lease on Nov 9th. I signed lease Feb 28th 2010. Have refused to do so because I can't afford being here to begin with. The $300 or $50 per pet charge does not say it is refundable upon termination of the lease. Have also had numerous problems with lack of hot water in my shower (have complained and they tried to fix but still doesn't work) and have been locked out of my apartment due to faulty front door lock. Have most recent episode on video. I had to go to work for a mandatory 8:30 meeting in my bathrobe after letting dog out. I couldn't get back in to change into my clothes. I HAVE TO MOVE because I cannot afford to live here anymore and the ongoing issues just add to the problem. Do I have a case with the sudden appearance of the pet rider which increases rent: MA state sanitary code 105 CMR 410; Increase of rent due to failure on there part to do a pet interview or fill out pet info pet rider: 940 CMR 3.17(4)(a)3. Also JUST gave me copies of my checks/receipt upon my asking for all info in my file nor does it indicate the amount of rent in advance for last month occupancy... is crossed out: (M.G.L c. 186, s.15B). I cannot afford my rent, have borrowed all the money I can and do NOT have more money to pay for my pets now and or any retroactive amount. I NEED HELP DESPERATELY AND SOON! I have to call Pat Beene on Monday to let her know of my intentions.

Agent Dec 23, 2010 LANDLORD UNWILLING: Landlord is unwilling to mediate a resolution to this complaint. Landlord has hired an attorney to handle this matter. According to landlord tenant is in breach of thier agreement and is responsible for penalties and fees regardless of their financial situation.
