COMPLAINT DETAILS (from renter)

My daught in the 2nd bedroom began breaking out with bumps on day 2 of moving into the property. We visited ER, Dr, Allergist numerous times. One night she sees a bug in her bed. After exterminator visits, he confirms there is a bed bug infestation. Apartments did help with cleaning the carpet prior to finding this information. They were very helpful when they thought the issue was my daughter allergic to the carpet or paint. My daughter moved from her sister's apartment. The sister's apartment has been verified to not have bed bugs. The house I came from does not have bed bugs. We believe the bugs were here when we arrived. The apartments is refusing to take any fault for the bugs and have basically left this as my issue. I am on a fixed income. The money spent for doctors and now for treatment of bed bugs is above my budget. And I believe without a doubt the bugs were here before we arrived. We had no symptoms previously but as soon as we moved to this unit my daughter began receiving bites. Bed bugs are hard to get rid of. One must be dilligent in getting rid of them. I feel the apartment should hold this responsibility as it is their responsibility to provide a hygenic, safe environment for me to live. I feel strongly that we did not bring the bugs. I can't prove this but they also cannot prove that the bugs did not live there before we rented the unit. My daughter is now afraid to live in the apartment, she is scarred from the bug bites, and I am in a leaseand paying rent for an aparment which I don't belive is being maintained as hospitable for me the renter. The aparments is cleaning the carpet and have arranged for the pest control company to give my aparments treatments for the bed bugs but they have left the burden for payment to me. This is where I feel they are in the wrong. I need help with getting them to pay for this or releasing me from my lease with no penalty.

LANDLORD / TENANT RESPONSES (2)
From Date IP Address Response
Renter Apr 15, 2011 70.56.183.31 i also was told there have been no bedbug complaints here, but on the date of my reinspection, i notice the pest control man and his beagle enter apt #2050 for a bedbug inspection. he then came to my apt for the reinspection. on 4-12-2011, the same carpetcleaning company that cleaned my carpets after treatment was at apt 2050 to shampoo carpet. this is a differnt cleaning company then the one normally used. i contend they have a problem, and are keeping it quite. now i just want out of my lease, so that i can move on with my life in a more open and more satisfing community.

Renter Apr 15, 2011 70.56.183.31 i still contend that the bedbugs were already in the apt when i moved in. The agreement i signed stating there were no bugs , should not be binding as most tenents like me check drawers, cabinets, and under sinks for insects. if we as tenents had to pay for a total bedbug, and or insect inspection before moving into an apartment, there would be few apartments rented out. i contend that i am not a licensed pest control expert, so i had no way of knowing what to look for..as of this post, we have been reinspected and told no more bedbugs, but 2 days ago my daughter washed her bedcover and was told by employees of the complex that they saw bedbugs in the washer she was using. now we are to be retreated, then reinspected. i cannot afford the payments for the first series of actions, let alone another teatment and inspection.
