COMPLAINT DETAILS (from renter)

I have resided at Seaside Grove since April of 2010. I started noticing bites on my body, and recently spotted actual bugs. I personally called Orkin on March 19, 2011 and they in turn contacted Seaside Grove. Kimberly from the front office contacted me on March 21, 2011 and informed me that Orkin would be coming that day to inspect. The inspector found one adult bedbug and a couple of nymphs in our boxspring and reported his findings to the front office. A couple of hours later, I went up to the front office to speak with Kristy regarding this issue. I was then informed that we did have bedbugs and that I was liable for the extermination fees estimated at $900. I asked her how we could be held liable when they were not certain that there were not bedbugs in other surrounding apartments. Kristy then said they would be checking the other apartments but in previous cases of bedbugs in the apartments, the people who reported it first were generally where the bedbugs started. Our lease is up April 1, 2011 and we have plans to move out into a new apartment complex before then. She then said that they were going to wait to exterminate after we moved out. So therefore we would be responsible for getting rid of the bedbugs that may be in or on our possessions we would be taking with us. On March 22, 2011 Kristy called to inform me that they had notified the surrounding apartments that Orkin would be coming to inspect. She also said the apartment below us had mentioned that they had bugs in the corners of their ceilings. After further inspection of the surrounding apartments, we were found to be not at fault. The extermination is now set to take place March 25, 2011 before we move out. They can not guarantee that our bedroom or living room furniture will be completely free of bedbugs. We do not want to take these pest to our new apartment. The only way to guarantee that we do not transport them to our new place is to get rid of all the furniture. I spoke with Kristy today March 24, 2011 and she stated that if we had to get rid of our furniture, that they were not liable for reimbursement. She told me that the apartment complex would be paying for the extermination, but not for our losses or inconvenience. We have also had to further burden ourselves with going out and buying trash bags to put all our belongings in, as well as spending money to use industrial washers and dryers to try to salvage our clothing and linens.

Renter Apr 8, 2011 70.60.217.230 Since the initial extermination, Orkin has followed up twice. The first time was April 1, 2011. During this visit, the Orkin man inspected both sets of mattresses and box springs. He sprayed the boxspring in the spare bedroom and the ceiling borders in all the bedrooms with a substance in a hand held container. When asked what he was spraying, the Orkin man stated it was unharmful like the chemical used in the initial extermination. The second follow-up date was April 7, 2011. On this day, Orkin solely sprayed the ceiling borders in all the bedrooms. The furniture was not checked during this visit. The living room furniture was never re-inspected. Today, April 8, 2011, I was sitting on my couch completing some computer work when I felt something crawling on my arm. When I looked an adult bedbug was spotted crawling up my left arm with my roommate as a witness. Kristy at the front desk was contacted, who in turn contacted Orkin. Orkin is scheduled to return on April 9, 2011 to further investigate.

Renter Mar 29, 2011 70.60.217.230 The name of the company that owns Seaside Grove is called Beach Company. The Regional Managers name is Donna Brashier. Kristy at Seaside Grove stated on March 29th, 2011 that she would need to be contacted regarding reimbursement issues. We also got a second opinion from Terminix regarding bed bugs. They stated that after the extermination process is complete, a 2 week waiting period should be carried out before the apartment is re-evaluated because the eggs could still hatch. Kristy is aware of this as of March 29, 2011. Our lease is up April 1st, 2011. Kristy verbally agreed that it would be ok for us to remain in this apartment until after Orkin could re-evaluate on or after April 8th, 2011. Kristy is also aware that we need a written statement from Orkin containing our name, the name and address of the apartment treated while we were residing here, the chemical used, and any other information pertinent to this extermination process.
