COMPLAINT : Breach of Agreement, Inability to park in allotted parking spaces
Fair Resolution according to renter :
  1. Have her pull her car forward to allow us to park in the allotted spaces
  2. Pay for the parking tickets that have resulted due to her not responding to our requests (and move her car)
  3. Refund $2900 deposit
  4. Reimburse for RPA Fees

COMPLAINT DETAILS (from renter)

The contract allots us 2 tandem parking spaces in the driveway. Our landlord has not allowed us to park in the allotted spots since one month after the lease was signed because it was an inconvenience to her, though she allowed her daughter who lived with her to park in one of the spaces. Finally, after much questioning and pleading, last month she allowed one of us to park in the driveway due to large amounts of tickets which were received from parking on the street without a permit. Since then, her car has not passed emissions and she is not allowed to drive it. She has removed the license plates from her car as evidence of this (in addition to her communicating this verbally). However, she refuses to pull her car forward so that we can use all of the parking spaces in the driveway. This has become an issue since now, both of the cars that need to park in the driveway do not have Somerville parking permits and will be (and have been) ticketed for parking on the street.

Agent Jun 2, 2011 LANDLORD REFUSAL: Despite repeated attempts both written and verbal, the Landlord/ Manager has refused to respond to the complaint. Due to the landlords refusal to cooperate with RPA Mediation, the RPA has no choice but to close this case. The tenant will need to seek other legal options such as court.
