COMPLAINT DETAILS (from renter)

I can no longer live inside my apartment due to pests. I wake up in the morning with bites and for the first month believed myself to be just getting hives to maybe a cleaning agent. I have spent roughly $400 in doctor visits to treat the problem. After the same bites appeared on my apartment guest, namely my fiance when he spent the night, I realized the possibility of them being bites. I have not been able to sleep in my apartment since and have attempted mass cleaning to stop the problem. This has not worked. I contacted the landlord and was told they could spray the apartment but at cost to me. I tried to file a loss of use claim with my renters insurance; however pests are not a covered peril. I have no interest in paying to spray for pests that I did not bring into the apartment, I will also not live in an apartment that has been sprayed with pesticides. I want to be able to move and no longer be contractually obligated to pay $595 a month for an apartment that I have not lived in for 20 days now.

Agent Jun 2, 2011 ATTORNEY RESPONSE: Eric M Steven, P.S. has responded on behalf of the landlord. His client (landlord) does not accept the proposed solution offered by the tenant. The landlord has adopted a infestation control problem as per RCW 59.18.060(4) in which Rock Creek Apartments regularly engages in infestation control. Ms. Ott's complaint of infestation appears to indicat "bed bugs" or some other type of infestation brought into the leashold unit by her or her guest. (According to the response provided by the attorney office)
