Here it states what exactly is the definition of a public place and place of employment. Not a residential area.

The title of the law that they use in their rental lease, says it itself. A law for smoking in public places and places of employment.

Here is the smoking page to the rental lease. It misuses the RCW 70.160.075 by calling the residential house we rented, public. This law does not apply to residential areas. There was no violation of our smoking policy per our contract.

This is the first post marked letter we received from the landlord. It is after the required 14 days under RCW 59.18.280. We believe there is no good explanation on why a letter was sent late. They with held our $700 deposit and there is nothing in the RCW 59.18.280 mentioning "Good faith estimates" as we were lead to believe. The accidental damage done to the outside of the house is in no way related and was quickly filed and taken care of by our insurance.

the top of this page shows that they want to apply left over insurance money to our statement they which to place on us, the misuse of the Washington smoking law RCW 70.160, the claiming of dropping a 500 dollar smoking fee but wanting to charge us for smoking damage, and other totals that go against totals of their first letter

This has been the most clear picture of the damaged door I've been able to find so far. You can tell at the bottom a few screws, and chipped wood. Also a dark space between the door and frame.

COMPLAINT DETAILS (from renter)

Failed to comply with the landlord duties of Washington law RCW 59.18.060. A metal electrical box hanging from cables on the north side of the house was to be mounted but never was. It would beat against the house in the wind, causing damage, threatened safety, and was an increasing hazard for accidents. During the first winter occupying the house, the back door split open and did not close. The door, a few days later, was nailed and screwed together as a temporary fix but left large holes/cracks between it and the frame. It was to be later repaired but was not, thus would allow much heat out and let cold in. In November of 2010, the living room heater became faulty, it would turn on for no more than a few minutes at a time, you would have to wait 45 minutes to an hour before turning it back on to try to get a few more minutes out of it. This problem was never fixed. Within the first few months of living at this residence, the "New" dishwasher's motor burnt out and took months to repair. There was defective light fixtures in the only bathroom. The decorative glass pieces would repeatedly fall and break the bulbs. This issue was also never fixed. Along with the violations, they also miss use the Washington smoking law RCW 70.160.075 in their lease. Trying to enforce it to residential areas. There's also with holding security deposit and demanding more money for unnecessary renovations he elected to do. This is still an ongoing dispute. They have also over charged my insurance company for accidental damage, and want to "Credit" the remaining amount towards the statement they want to place upon us for these unnecessary renovations.
