COMPLAINT : Breach of Agreement
Fair Resolution according to renter :
  1. Refund $350 deposit, since I was never permitted to occupy the apartment and cancellation of contract.

COMPLAINT DETAILS (from renter)

I submitted the application, was approved. So I paid the deposit and submitted the signed contract as requested and received confirmation that everything was approved for the period of August 1, 2011 to February 28, 2012. Nowhere in the contract did it stipulate that I am only allowed to move in on certain days. When I contacted the apartment management to inquire about how I could obtain my keys and check-in for my projected move in date of Saturday, August 6, 2011, their reply was that I am not allowed to move in on Saturdays, even though they keep office hours on that day. When I asked why I would not be allowed to move in that day no legitimate explanation was given. I explained to them that I am obligated to work Monday to Friday, so Saturday/weekends are my only option. Their only proposed solution was to have a friend/family member of mine in their area come check-in for me. I told them repeatedly that I am moving from out of state, and it would be completely illogical to assume that I even had acquaintances who live in Idaho, which I don't. Their solution and policies are both absurd and nonsensical and they have not provided me with any legitimate explanation for not being able to take 15 minutes out of their Saturday office hours to walk through the apartment with me and hand over the keys, other than that's been there policy for years (but they never informed me of this policy until everything was already submitted). I was not provided advance notice of this condition, and if I had known it existed, I never would've signed the agreement or paid the deposit. I have copies of the contract and the emails exchanged with the landlord to confirm my claim.
