1. He charged us for an extra dumpster pick up after we moved because he said we filled the dumpster. However, we did not get rid of anything large or any furniture and I took a lot of recycling to my work. We had only the normal amount of moving out trash. When we went to throw it out, the dumpster was already full! The dumpster is used by people in several units.
2. He charged us for miscellaneous cleaning, but we cleaned the apartment before we left including the stove, oven, refrigerator, all bathroom items and floors. He said there was a scum on the bathtub tile, but it was like that when we moved in. The "scum" is actually hard water stain.
3. The water turned brown and muddy from the spring runoff and we were unable to drink it or cook with it. We had to buy bottled water for a month until it cleared. We were bathing in dirt water. He never told us this would happen.
4. He took money from us to fix a door latch that was broken when we moved in. He never did a walk-thru inspection with us and I didn't take pictures because he was so friendly. We had hung out with him on occasion and he lived below us frequently during ski season.
5. He charged us $25 for heat when he was staying frequently in the apartment, especially during march and april. He also had guests. He did not pay for heat during this time because he was also staying with a woman he was renting the place to. Also, the lease says that the heat bill goes for two apartments, but the boiler is connected to three apartments. The heat had been malfunctioning and our apartment was either really hot or ice cold. He tried to fix something with it unsuccessfully, but the next month we got the charge for and extra $25!
6. He charged us to replace a piece of molding around the front door that had been hanging on by one nail and came off when my baby pulled on it. He also charged us for an old, original 1970's window handle that broke when Ed pulled on it to open the window.
7. He charged us for clearing a clogged garbage disposal. The disposal had a pvc pipe drain whose circumference was smaller than the disposal and was clearly a band-aid hack installment.
8. He specifically hung a piece of art over a hole in the bathroom door and then told us he did that so we wouldn't notice when we came to see the house!
9. He often lived in the apartment below us, but never paid for plowing. All the other tenants pitched in $10 per car.

LANDLORD REFUSAL: Despite repeated attempts both written and verbal, the Landlord/ Manager has refused to respond to the complaint. Due to the landlords refusal to cooperate with RPA Mediation, the RPA has no choice but to close this case. The tenant will need to seek other legal options such as court. |
