Fair Resolution according to renter :
  1. Reimbursement Payment for fees associated with exterminator
  2. Reimbursement Payment for out of pocket expenses incurred as a result of failure to disclose ongoing bed bug infestation in the building

  4. Deduction of rent in the event reimbursement for these items is not achieved

COMPLAINT DETAILS (from renter)

On or about July 22nd, my daughter was diagnosed with an allergic reaction to bed bugs. We immediately began to spray the entire apartment in order to exterminate them, and notified the Super of the problem. We discarded my daughter's mattress, washed all of the clothing in the apartment, and removed the carpet in the bedroom. When we realized that the problem was ongoing, and had begun to spread to other areas of the apartment, we were told by the Super to contact the landlord. I requested that my daughter-in-law contact the landlord in order to arrange for an exterminator. On August 12th, my daughter-in-law, Francesca, contacted AGM, and spoke with Laura in the office. Laura and an unidentified gentleman (whom I believe to be the owner) informed Francesca that they would make arrangements for an exterminator, and agreed that it was the landlord's responsibility to cure the problem. They instructed Francesca, who left her name and telephone number, that they would call her on Monday (the 15th) with an update on when to expect the exterminator. No one called. On Wednesday morning (17th), Francesca called and spoke with Laura again, who seemed to be under the impression that the exterminator was hired. She stated that she would check on the status and call Francesca back, Francesca leaving her number a second time. . She did not. On Thursday (18th) afternoon, Francesca called and left a voicemail for Laura indicating that she was checking in on the status and left her telephone number for the third time. On Friday (19th), Francesca called Laura again, and asked what the status of the exterminator was. Laura stated that the exterminator was coming Saturday. When asked by Francesca for the name of the company and why no one was notified, Laura stated that she would have to call her back in 30 minutes. Francesca left her telephone number for the fourth time. When Laura called back, the same unidentified gentleman came on the line and stated that he had not booked an appointment with the exterminator because the apartment needs to be wrapped in plastic. when Francesca inquired regarding the name of the Company, she was informed by said gentlemen that "she did not need to know." The landlord was very rude, accusatory and stated that he would not provide the plastic because it was "our problem-not his". Also, we have reason to believe that other tenants have been infested with bedbugs prior to our infestation.

Landlord Aug 31, 2011 108.54.4.223 I was notified that the tenant had bedbugs on Friday August 12 ,2011 at 4pm. I told her that I would contact the exterminator and get back to her once I heard from him. On Friday August 19 we notified the tenant that she would need to wrap all their belongings in plastic bags and sealed with tape. The tenants daughter in law told us that she would call us back when it was all done. Francesa never contacted me back.. On Tuesday August 23 I had hired a exterminator to go to the apartment he was there at 10 am. This is the first issue that this building has ever had. This tenant had brought in the bed bugs and infested their apartment. This tenant took 3 weeks to notify the landlord of the situation. We are not at any fault ,once we assessed the situation we cured it. Tenant did not hire any exterminator on their own.
