COMPLAINT DETAILS (from renter)

I moved in to this apartment on aug 24, 2011. On september 2, 2011 at around 11pm, I found bed bugs on my recliner sofa. I contacted the leasing office on september 3rd 2011. They are wanting me to pay for the expensed of eradication. I previously lived at Allandale falls apartments, Kingsport TN for 2 years and never had any problems( This apartments are owned by the same group as the current one). On the lease they have a bed bug addendum that requires notification of bed bugs in 48 hrs of move in. I am a doctor in proffession, and I know it is impossible to spot these in a limited time frame as they hide in crevices and are mostly nocturnal. Another clause of the lease required notification at the earliest. I know that landlords are supposed to provide a habitable environment, which I believe has not been done in my case. Also the previous tenant was evicted for reasons unkown to me. It is very clear that I was affected by bed bugs only after I moved into these apartments. I have only verbally notified them of the problem. I will send you a scanned copy of my lease pertaining to bed bugs, Please let me know what my options are. I believe that this lease was purposely written to put me at blame and I dont want to be held responsible for the bed bug infestation problem and its eradication.

LANDLORD / TENANT RESPONSES (3)
From Date IP Address Response
Renter Sep 11, 2011 75.130.72.216 I spoke to the manager on 9/10/11. At this time since terminix has not found any signs of infestation, they have decided not to perform any extermination. We are still waiting on the official letter from terminix stating that they have not found any signs of inspection. Ms Alicia Olson has also informed me that they have checked with the management of my previous apartment and they have not found any signs of infestation at my previous home either ( owned by the same company). Also on September 3 rd when we first found the bed bugs on our recliners, after informing the leasing office we immediately had our recliners ( one 3 seater and one 2 seater) disposed to the landfill area. Ms Olson also said that there was an official log on bed bugs maintained by the superviser where they have documented the visits by terminix on both occassions noting that there were no signs of infestation in my belongings. She is going to give me a copy of th same. She has also requested to give a written statement documentin the events thus far and would be signed by both parties and maintained on the file. At this time, I and my wife are having to sleep on the carpet in the living room to make sure that the bugs if present would bite us and not spread to any other room. This is really stressful and causing sleepless nights for all of us. Since terminix has inspected out personal belongings twice and found no signs of infestation and also no signs of infestation in the previous apartments at this time the leasing office I dont want to be helf for extermination process if I find further bed bugs in my apartment. I have already had to dispose my furniture and am experiencing stresful sleeples nights.

Renter Sep 9, 2011 75.130.72.216 Terminix once again inspected my home on 9/8/11. They have not found have any activity to suggest bed bug infestation in my belongings, They have also inspected the living room (where we found the bed bugs) and removed the carpet and power outlets and have not found any activity at this time.

Renter Sep 6, 2011 75.130.72.216 Today a person from terminix and the manager came to inspect the home, they have inspected our belongings from the old home including my bed and chair. The person from terminix said he was not able to find any activity suggestive of bed bugs. I have asked him to give me a statement on an official letter head stating that he has not found any signs of infection in my belongings. I have also asked them to reinspect the home with the carpet removed ( to make sure there is no infestation from prior resident).
