The apartment (#149) is currently uninhabitable due to the ongoing bed bug infestation in the location. From day-1 of move-in (with no furniture), the apartment showed signs of bed bug activity. Already in breach of contract, the apartment manager (Victoria) attempted to address the situation by providing pest control service that mis-diagnosed the problem of bed bugs. The treatment worsened the condition in the apartment causing an even more aggressive infestion of clothing, furniture, and biting activity of the bed bugs. I have incurred multiple bites (with an allergic bite reaction) and have suffered the loss of sleep as well as time consumed in washing every piece of clothing I own. In addition to the health issue caused by the bed bug infestation, I have been unable to care for my children in this location due to the fear of spreading the infestation to them and their primary residence. This has resulted in increased daycare cost for my spouse, who is the primary care giver for the children.
After arguing the validity of bed bug infestation in the apartment, the complex manager finally acknowledge the situation (3 weeks later) with the concurrence of an outside pest control service, that the apartment was indeed infested with the bugs. A bed bug treatment was performed on the apartment by the manager's pest service that has been ineffective in killing the infestation. The continuing infestation has resulted in the loss of both my bedroom mattress and living room furniture that was kept in the apartment.
Even with additional treatments, it is likely that the infestation will continue due to the fact that there are adjacent empty and occupied apartments (with common ducting) that the manager refuses to treat due to cost. After arguing the fact that these pest were not brought in by me or my stuff, I pointed out that the apartment complex maintains a large number of residence immigranting from third-world countries (Haiti and Mexico). The CDC website specifically points out that the bugs are known travelers from these developing countries. Without knowledge of who lived in the apartment before me, it is highly likely that these pest were either transported in via a former tenant or have been transferred via the ducting from someone else's apartment to the one I was living in. Either way, the complex is no longer inhabitable by me or my family and I am requesting cancellation of the current lease contract.

LANDLORD REFUSAL: Despite repeated attempts both written and verbal, the Landlord/ Manager has refused to respond to the complaint. Due to the landlords refusal to cooperate with RPA Mediation, the RPA has no choice but to close this case. The tenant will need to seek other legal options such as court. |
