COMPLAINT DETAILS (from renter)

We complained to the landlord about possible bedbugs in our unit. We just started having this problem at the end of our 3 year stay. Landlord sent orkin who claims to have found bedbug activity and proposed a heat treatment for approximately $1600. We had told the landlord that it is unfair to put the entire responsibility on us as our lease does not have any clause about pest control or bed bug treatment. We were moving out soon in the next couple of weeks and we had already given our move-out notice, we had to move our things out by that weekend as my wife had to join work in the new city the coming monday. (At this time we were on a month by month lease). As the property manager was on leave before we left, we told the assistant property manager clearly that we do not agree to pay the entire amount and we would like to resolve it with the property manager once she comes back. We asked them to call us in the mean time. We waited for their call, but they never called (We have our cell phone records to prove that). Next weekend when we got back to take our car and return the keys we found that the treatment was already done without our consent. Since then we have tried to negotiate with them and even agreed to forego our security deposit.But they are unwilling to negotiate and claim that they had tried to contact us before entering the apartment to do the treatement and we never responded(which is entirely false). They are charging us for the treatement in 2 bedrooms (approx $800 / bedroom). This was unnecessary as we were using only 1 bedroom and the other bedroom was being used as a study. We had mentioned this to the assistant manager on the very first day. Recently after our incident the landlord has included an addendum on the new lease on bedbug policy. We have moved to a new place and since then we have not experienced any bedbug issues.

Due to the landlords refusal to cooperate with RPA Mediation, the RPA has no choice but to close this case. The tenant will need to seek other legal options such as court.
