COMPLAINT DETAILS (from renter)

When we signed the lease for 600 Grand Ave #1 in March of ??. We were told by landlord that we could move in 2 days early (February 26 2009) however, landlord also admitted that since we would be moving in early, this would prevent her from cleaning the unit. However, landlord assured renters that the unit was in ??good condition? and was clean enough already, she also offered $60 off of the first month??s rent because we had to clean ourselves. Upon moving in we found that the carpets had not been cleaned, as will much of the rest of the apartment. The old blinds for the windows were damaged and we were unable to fix. Many of the screens for the windows had holes, or were not fit in the windows properly. None of the appliances were cleaned and the unit had not been repainted (we finally repainted ourselves, with permission of the landlord, using our own finances). There were some places where fixtures were pulling away from the walls and paint was chipping off. The previous renter left many personal effects behind including full closet and junk for us to throw away. Also we were surprised that there was not a form to document the condition of the apartment upon move in. Therefore I decided it to be in our best interest to make a video recording of the condition of our apartment, since when we moved in, other tenants warned us that our landlord was a ??slumlord? and difficult to work with. Move in was no exception, we began to have issues with the unit immediately. The number one issue in the unit was the lack of heat. The first evening we stayed we tried to remedy the low temperature (locked thermostat, set at 68, but temp throughout the winter as 54-60 degrees) with a space heater, which immediately blew the fuses for the apartment. Our landlord notified us that we would no longer be able to use heaters due to the electrical work. Needless to say over the years there were calls at least once a month complaining of lack of heat. The response we got was that the heater was working, and that the tenants upstairs were warm and needed to open their windows due to the warmth. So each winter we continued to freeze, even paying for our own window sealing kits, which did not help with the temp. Our unit was so cold that company refused to come over because they could not stand the cold. The only thing we could do was boil pots of water and walk around with 4 layers on to try cope with the temperature of apartment. Our land

Agent Jan 27, 2012 LANDLORD REFUSAL: Despite repeated attempts both written and verbal, the Landlord/ Manager has refused to respond to the complaint. Due to the landlords refusal to cooperate with RPA Mediation, the RPA has no choice but to close this case. The tenant will need to seek other legal options such as court.
