In March, I rented an apartment that was under construction with the understanding that there could be delays. I told Beverly at the time, I could go month to month on the lease I held at the time, with notification. Beverly told me she spoke with her manager and that they were confident it would be finished by the beginning of May. I was approved and put down a holding deposit and then gave the 60 days notification required of my residence at the time. I received a confirmation email from Beverly letting me know what would be required before my move-in date, and that she would be in touch with me as the date got closer. In Mid-April, I happened to drive by the property and saw the construction progress. At that time, I was concerned that they would not be finished by the time my move-in was scheduled. I called Williamsburg as well as emailed the property, at which time I was told they were at least 6 weeks behind schedule. I then called the leasing office to extend my lease month-to-month, and I was told it was rented. I then spoke with Williamsburg again, and went over to the property to look at what they ad available that might work. At that point, what they offered was unsuitable for my needs. Beverly told e she would be in contact with me after she spoke to her after she spoke to her manager about the situation and the refund. I did not here back from her. I attempted over the course of the next five weeks through emails and telephone calls to get an answer, and received email responses that I would be called or contacted in a matter of days. Each time, they did not follow through. Today, May 22nd at about 1 pm, I finally got Beverly on the phone. At that point, she told me they would not be refunding my holding deposit as a matter of policy, and she also old me that I said I could go month-to-month on the lease. I reminded her if the conversation, where I said with proper notification I could do that. Williamsburg left me in a terrible position, having to scramble to find another residence. I believe I am entitled to the return of my deposit, though not the application fee. Can you help me resolve ths. I have rail correspondence I can forward.

FORCE REQUIRED! After repeated attempts to resolve this complaint; management has FAILED to comply and requires force. The RPA has taken all reasonable efforts to contact the Landlord / Manager. They have REFUSED all request and will require FORCE. This case is closed with a negative disposition. |
