COMPLAINT : Unjustified 2nd Notice of Noise complaint received from Landlord.

COMPLAINT DETAILS (from renter)

I specifically requested a 3 bedroom apartment, away from noise sensitive neighbors since we have a 3 and 5 year old, both are noisy on occasions, playful and like to do what every other child their age does, laugh, jump, run, just normal child behavior. We suspect our son has O.D.D. and are seeking medical assistance for his temper outbursts. But that said, that's not to our knowledge what's causing the problem. Firstly we are attached on all sides, and the physical building structure is very, very prone to noise transmissions, especially through the floor. When I am in our garage, even the lightest of footsteps, is massively amplified and does truly sound like people are thumping hard on the floor even when they are walking quietly. Our master bedroom is directly above our elderly neighbor and we cannot even walk around in there without her constantly complaining to the management and calling the courtesy officer. In 5 months we have received two letters from the landlord complaining of excessive stomping (which is completely unjustified) and noise after hours (10pm) (which we know is pure fabrication). Both me and my wife lead a relatively simple life and are most always in bed, asleep long before 10pm and the only movement she is likely to hear would be my son who on occasions climbs in bed with us 3 or 4 o'clock in the morning whenever there is a thunderstorm or something upsets him. On occasions, he like my baby daughter has noisy tantrums, but they rarely last more than 10-15 minutes. This neighbor started banging on her ceiling the day we moved in, all because my daughter in an excited manner skipped across the floor. She weighs barely 40lbs. Anyone who has lived with kids and / or lived in an apartment knows that everyday noise disruptions occur. We keep our TV down, we are respectful to our neighbors, we don't play loud music, we try not to make too much noise but at the same time we have to live as does everybody else! We have a very understanding neighbor on the other side, which had the courtesy to inform us that her baby girl is poorly and needs to rest during 1-3 every day and that on occasions; our kids were disturbing her nap time. Our son was ill once too, so we agreed that we would do our best to keep them quieter and / or either take the kids to the park without hesitation. This is seriously affecting all of my families mental health and happiness. Please help because if this continues I WILL be contacting my attorney.
