On April 29th 2013 my husband and I met with Helen Gunter to view the property at 1050 Casa Dr. in Clarkston, GA. Mrs. Gunter Stated that she would rent the house for 700.00 dollars and a 500.00 dollar security deposit. She asked If we can do the application and she will have everything checked out the following day when we were to give her the deposit if everything goes thru. On April 30th Mrs. Gunter called me and my husband and left a message stating that my current landlord said that we have to give a 60 day notice. I told Mrs. Gunter that my lease would be up June 1, 2013 thats when we wanted to move she stated that was ok and. I also asked did she check evrything on app and she stated yes and when can we meet her with security deposit. I told her in a hour and a half. Mrs. Gunter met me and my husband at the Texaco which is the gas station up the street from the rental. Before giving Mrs Gunter the money order of 500.00 I asked her again were we approved for the house Mrs. Gunter stated yes. I also asked her after I received the receipt and seen that it said non refundable what does that mean. Mrs Gunter stated thats only if we were to back out of the agreement and not choose to move in. She stated that the deposit is refundable if her and her boss back out but she don't see that happening. She stated that we had the house and we were to pay her the full amount rent on June 1st and sign lease. The same day about 4 to 5 hours later Mrs. Gunter stated on my voice message that she was sorry that her boss said that since we didnt have a lawn mower and they couldnt furnish a fridge she would give us our money back when the money order clear in her account. It has been three days and Mrs. Gunter refuse to return any of our money. She stated that she would refund 400.00 dollars and I accepted then she said that she would send it and she hasn't. She will not return phone calls or give us our money. She sent a letter stating that the application was denied so she kept our deposit. Can someone please help my husband and I with this situation. I really do not want to take this to court as I stated with her but she will not cooperate.
