COMPLAINT DETAILS (from renter)

I have vacated the property at 1710 Pawnee Ct in Leavenworth, Kansas Effective 5/31/13. A 30 day notice was provided. On July 15, 2013, we received a notice demanding payment of $3721.77 payable by 7/15/13. A forwarding address was provided when keys were turned in and they had phone numbers where we could be reached at as well. We did not clean on moving out as we just ran out of time. We acknowledge this. There were pet stains on carpeting, and this is acknowledged as well. The charges presented were as follows: Cleaning - $440.00 Utilities for cleaning - $55.00 Carpet replacement – $3711.77 Sub floor treatment of Kilz – $350.00 Exterminator services - $165.00 Less Deposit - $1000.00 Total - $3771.77 The carpeting in the master bedroom was supposed to be replaced due to large amounts of glass from door shattered in storm. The master bathroom had older carpeting, not new. The upstairs bedrooms did not have new carpeting. The basement had old redish carpet. We should not be charged for the older carpeting and the carpeting that was new upon moving in should be depreciated as we resided there for 7 years. The landlord, Larry Day, threatened court and garnishment in the letter that was mailed. I have made two calls to him, one of which was returned but no direct contact information, and another threat of court. While we resided in the property, there was a major storm that shattered a sliding glass door in the bedroom. It took 2 days before the manager got the door boarded up, so we had to stay in the residence with no power and an open area. Electricity was not restored for over 48 hours because the debris was not cleared for the power company. When a crew was hired they did not clean all of the debris they were supposed to clear. The shed was replaced, but the fence in the back yard was never repaired and bushes were left lying flat. The paint on the walls was primer. Any cleaning of the walls took the paint off of the walls. We were not allowed to repaint. There was a plumbing problem where if the upstairs toilets were flushed at the same time, the sewer would back up through the downstairs sink. We were responsible for this as it was in our required payment portion. When we moved in the garbage disposal was full of broken glass and had to be replaced at our expense. The refrigerator was full of mold. At 11:38 on 7/17/13 I spoke with Larry and he refuses to depreciate the carpet and is demanding payment for replacement of all carpeting in the home. At this point he is not willing to negotiate with us.

Renter Jul 29, 2013 12.234.144.10 Once again, landlord did not notify of intent to withhold from deposit within the 30 day requirement. The carpeting stated at 10 years old would now be 17 years old. The residence was occupied for 7 years. Not all of the carpet in the upstairs was new upon assuming tenancy. No depreciation on the carpeting was allowed. The basement had issues with the sewage backing up through the basement sink. They had been made aware of this issue. There was damage in the master bedroom out into the hall from a storm of which they provided no cleanup / replacement to the interrior. In 7 years, the landlord made entry to the residence1 time, after the storm damage. They did not follow up afterwards.
