Below is the email I sent Jan after she finally returned my multiple calls and messages I had left for her prior to 10/11/2013. I had been calling her for over a week to try to resolve the issue. She said she was in tax court when I finally heard back from her over a week later. I explained how distruptive the construction has been and asked why she never mentioned the impending construction during our lease signing only 20 days prior. She said she didnt know about the construction, but then later admitted that she was aware that there was construction scheduled to start that she never mentioned to us because she thought the AOA had put the project on hold: Good Afternoon, As discussed on the phone on 10/10/2013, Kahala Towers is under construction till the end of 2014 according to the property manager. Currently they are jackhammering at 7:30am and removing the paint and concrete from the hall ways. This is causing major disruptions in our quality of life. Every night I get home from work and there are paint chips and sediment all over my bed and my room. This is unacceptable. The resident manager implied that you were aware of the construction and the conditions. You never mentioned any of the construction to Stacy or I during the lease signing and therefore we feel it is against the Tenant/ Landlord Laws for Hawaii. Other concerns that you are aware of, but have yet to address include: We never received a mailbox key. We moved in on Sept 20 and it has been 20 days that we have not been able to check our mail, this is unacceptable and against our federal liberties. The stove top only has two functioning coils. Both toilets run. And there are still several outlets in the kitchen that don't work. I have pictures that i will email to you of the construction and the mess it is making in the unit. I will email them separately from my phone. I have discussed they issues with Stacy and we both feel that these issues have made this unit unlivable. And by the standards written in the Tenant/Landlord Laws we would like to discontinue our lease with no financial repercussions on Oct 31st, 2013.
