I filed case #23-3057 on October 1, 2013 regarding my need to terminate my lease early at Vista Grande Retirement Apartments due to the toxic living environment and harassment I experienced over it's pet policy. I had faxed Monarch Properties District Manager Theresa Kester on 8/30/13 and made a generous offer for Monarch Properties/Vista Grande to retain the $475 sum comprising a $175 security deposit and $300 pet deposit as well as the $258 iron fence (see photo attached) I had erected at my apartment. I offered this to cover any and all exit fees. Also, since this sum included a security deposit, I felt it was sufficient to cover any and all alleged damage to the apartment at the time of my move-out. However, recently, despite what I perceived as acceptance of my settlement offer, Vista Grande Leasing Agent Linda Abrahamson mailed me a bill for $863.36 which lists $600 for lease termination fee (see attachment). Also showing on this document is $107.12 as "balance at move-out" which is unexplained, and $217 for "rental concession", also unexplained. The $46.36 shown for final electric charges is just as bogus as the $42.12 electric bill previously received which Abrahamson admitted to a neighbor/friend/tenant (whose bill was the same amount as mine) that the sum was inaccurate since the meters on our side of the complex were broken. Abrahamson took $20 off of my friend's bill but made no effort to fairly adjust mine. This is typical of the unfair treatment I experienced at Vista Grande at the hands of Abrahamson. My offer of the $475 plus the retention of the $258 iron fence at my unit was made as a final and complete settlement to my move-out. Accordingly, I am asking that the $495.48 "balance" reflected on the attachment be waived because as a senior living on a sparse income, I do not have the means to pay it.

Renter Nov 24, 2013 174.28.167.97 1.11/24/13: Having heard no reply to my Rental Protection Agency complaint #23-3305 from Abrahamson of Vista Grande Apartments, I am alerting Monarch Properties of the fact that seniors in New Mexico enjoy the protection from garnishment of their pensions in the same way that the Federal Government protects Social Security income (see attachment entitled "Senior Monetary Safeguard"). The $475 plus the $258 iron fence left at my former unit is a fair and reasonable settlement proposal for my early move-out and sufficient enough to cover any and all legitimate expenses. Although I had hoped for an amicable parting, this may prove not to be the case. I have moved on and hope Vista Grande/Monarch Properties can do so as well.
