Samantha Stiffler took a total of $1,870 from us to break the lease for a family matter, even after we showed good faith by getting the lease termination papers notarized like she had asked, and we helped find new tenants, which moved in the very next morning. Samantha did not lose a single month’s rent with us moving out early, but collected both of our security deposits, Augusts rent from us even though we didn't live there and she didn't lose rent. She possibly collected rent for the month of August from us, and from the new tenants which is illegal in the state of CO to collect rent twice for the same month from different parties. There were several things that were said to be taken care of before we moved in which were not. That includes: fire detectors did not have batteries and were not installed, she did not leave new batteries either, window screens were taken out and not replaced, there were dead bugs and leaves left inside of the fire escape door, she listed the air conditioning as working and it never did, when we asked to get it fixed she never took care of it. She left a huge mess of a very sticky something on the kitchen counter that was not cleaned, 4 light bulbs were out including one that was broken into the socket that required the power to be turned off to remove safely. I fixed these matters myself and never pursued her for anything, not reimbursement for what I had to buy or for my time to fix and replace. She is now taking me to small claims court for matters that are much smaller then what was wrong and what I took care of when I moved in. She is taking to me court for things such as, dust on the radiator, leaves on the patio, a small paint chip that came off the door, not giving her a receipt of shampooing the carpets when I told her I own my own carpet shampooer so i didn't have a receipt, she told me face to face that was OK and now its not. Most importantly she did not follow the legal notification process. Our signed lease and Colorado state law states the only acceptable form of notification of damages or cleaning costs must be a written letter sent by certified mail return receipt requested. This first step must be completed within the allowed 60 days or under Colorado Law she forfeits any right to collect for damages or cleaning. I informed her of this and I was then served with small claims court papers. She does not take the laws she has to abide by or the responsibilities of being a landlord seriously.
