COMPLAINT DETAILS (from renter)

Our landlord was notified that we were moving out of our apartment at the end of February 2014 due to purchasing a house on February 14, 2014. Everything was removed from the apartment by February 15, 2014, and we notified Mr. Gerver through a text message that we wanted to do a walk through with him. He said he would check it out, and two days later on the 19th of February he sent me a text message saying, "Stacey, apartment looks good, thank you!" He asked us to return the keys by placing them on the kitchen counter. When returning them on the 25th of February, the apartment contained painting supplies and other construction tools. Rooms and the fireplace were completely painted, and we never gave him permission to be in the apartment. When receiving our electric bill, it shows that someone was in the apartment using electric on days we weren't present. Since we paid for rent until the end of the month, we did not have the electric turned off until then. Therefore, he illegally entered the apartment without our permission. When we finally received our security deposit on March 15, 2014, $200.00 was deducted without any specific breakdown as to what it cost to "fix" the bedroom ceiling fan and to clean and paint the apartment. After trying to reach him, he responded to my voicemail via text message. Even though he informed us previously that everything was good, he now indicates things were wrong with the apartment that he, "...didn't see when he walked through the apartment." Rather than telling us prior to the end of February, he waited until after our lease ended to tell us that anything was wrong, so we couldn't fix the problems prior to leaving. He never responded to my request for a breakdown of what each repair cost through proof of receipts. On March 29, 2014, I sent him another text message asking for the status on the copy of the receipts. He never responded. On April 2, 2014, I sent him a third message about receiving copies of the receipts. I stated that I wanted them by April 15th, a month after originally asking for them. If not, I was going to contact the Attorney General's office and/or the Rental Protection Agency. I also asked him to let me know how he wanted to proceed. I never received a response. After the Attorney General's office contacted him, he did not provide receipts for the items that he stated he used the money for in a text message. Instead, receipts for other items not mentioned to us were provided.
