COMPLAINT DETAILS (from renter)

I rented a motel room at the Thunder Cove Hotel, L. L. C. located at 311 Cliff Street, Deadwood, SD 57732. My rent was paid on time and the room was always left in great condition with no damages. On approximately 9/13/2017 at approximately 8:30 A. M., MST while getting coffee in building 315, Marc Hice sexually harassed me in front of the coffee machine-UNWARRANTED and UNPROVOKED. On 9/15/2018 at approximately 5:30 P. M., MST, Marc Hice made a disparaging comment to be while standing outside building 311 that was UNWARRANTED and UNPROVOKED. On 1/30/2018, I noticed that my wooden back brush was stolen out of my hotel room. My room was not cleaned according to the contract on two occasions as well. On 1/31/2018, I also noticed that my rhinestone watch was stolen as well. I confronted Mark Hice about the stolen items out my room and he brushed it off. On 2/3/2018, I filed a police report in regards to the stolen items out of my room. Mark Hice made a false official statement on the police report. I came back to the hotel about an hour later after filing a police report only to find that Mark Hice, Sharla Hice, and the Officer were heading up to my hotel room. I proceed to follow them to find out exactly what was going on. Mark Hice proceeds to give me an illegal 3-Day notice to Quit with falsified statements rendered on the document. I did not sign the document, however, I did ask for the document to prove landlord harassment which is in my possession. After receiving the illegal 3-Day Notice to Quit for no just cause, I advised Mark Hice and Sharla Hice that I was going to sue. In addition to this matter, Mark Hice and Sharla Hice lied to the police officers on 3 occassions. Mark Hice and Sharla Hice left and I spoke to the Officer and advised him that I recovered my watch and that the wooden bath brush was not recovered. The Officer was professional and understanding. I proceeded to put black duct tape on the locks in order to prevent an illegal lockout and I digitally recorded this and released it on you tube. I stayed at the hotel for an additional 3 days. On 2/6/2018 at approximately 1:30 P. M., MST, I noticed the Deadwood Police at building 315. Mark and Sharla called the police in order to harass me for no just cause and I showed the Officers the illegal 3-Day Notice quit. I also showed the Officers the Cease and Desist all forms of Defamation, Libel, and Slander along with an Assurance letter for Mark Hice to sign and send back. I also showed the Officers the Cease and Desist all forms of criminal harassment under Title 18, United States Code, subsection 2261A. Mark and Sharla were standing behind the counter in building 315 and Mark Hice proceeded again with harassment by telling me to get out and that he did not trust me. This was digitally recorded as well. The Officers spoke with Mark and Sharla and I was advised that I would receive my refund of 200.00 that I paid for the deposit and that I would receive a receipt in the mail. I advised the Officers that I needed about an hour to get my property out due to the criminal harassment. Upon leaving the property, I digitally recorded the room and I also had an eyewitness to confirm that the room was left in great condition and there was no damages prior to leaving. The Officer took the hotel keys and gave them to Mark Hice. I have yet to receive my 200.00 deposit back which is theft. I have yet to receive the printed receipt in the mail. I have yet to receive the legal documents signed by Mark Hice in the mail. I contacted the owners of Thunder Cove Hotel in regards to this criminal activity by both Mark Hice and Sharla Hice. This also includes the maid, Karen Nichols as well. Why do you believe you are being discriminated against?: *Discrimination due in part that I am woman who resisted sexual advances by Mark Hice *False official statements given to police on three occassions by Mark and Sharla Hice. Violation of Title 18, United States Code, subsection 1001 *Petty Theft under SD Codified Laws pursuant to subsection 22-30A-13 which is a Class II Misdemeanor which is 30 day imprisonment and a $500 fine. There are only 3 people who have keys to my hotel room and they are Mark Hice, Sharla Hice, and Karen Nichols. *Landlord harassment and retaliation for filing a police report of stolen items *Discrimination based on Americans with Disabilities Act *Violation of the Fair Housing Act, Title IV of the Civil Rights Act of 1964 *Violation of the Fair Housing Act of 1988 *Violation of Title 42, United States Code, subsection 3601 *Violation of Title 42, United States Code, subsection 3604 *Violation of Title 42, United States Code, subsection 3631 *Violation of Title 18, United States Code, subsection 1091 *Violation of Title 18, United States Code, subsection 2261A *Violation of Title 9, regarding the offenses of Public Order and Decency pursuant to Chapter 42, Disorderly Conduct & Related Offenses under sec. 42 pursuant to section (4) and (1) by Mark Hice
