COMPLAINT : Failure To Refund Security Deposit
Fair Resolution according to renter :
  1. Immediate Refund Of $500 Security Deposit In The Form Of Business Check Or Money Order Sent Next Day Mail.
  2. Immediate refund of $500 deposit via PayPal so as funds are available immediately devoid of any fee.

COMPLAINT DETAILS (from renter)

On 1/14/19 I returned an application for residency at Bayshore Mobile Home Park in Hot Springs. On 1/18/19 I received a message stating I had been approved. 2hrs 40min later I make the $500 security deposit. I realize after this that I would be unable to get reliable internet service. I\\\'m a student and must have reliable internet for school work. I called the next day and was told to call back the following Monday to talk to the property manager. I called Monday morning, 1/21/19, at 8:15am and was told the property manager was in a meeting. I asked if I could call back around 11am and was told that was fine. I called back at 10:49am leaving a voice message stating my name, that I was seeking to speak with the property manager about the refund of my security deposit, left my phone number, and hung up. I called back two more times this day to no answer. I called back on Wednesday. I spoke to a woman named Amy who said she would send an email to see who had the right answer for me as to whether or not I could get my deposit back. I called back on Friday, 1/25/19 at 2:05pm and asked for Amy. I was told by a woman that Amy was not in and that she was the one I needed to talk to. She never identified herself by name. She said I couldn\\\'t get the deposit back because it stated on the application I signed that the security deposit was non-refundable. She offered to email it to me and I accepted. She read my email back to me to confirm and we hung up. I called again on Monday, 1/28/19, as I had still not received the email. After going by the Bayshore office and finding it empty, I called again. I left another message requesting the email of the application. It was sent around 11:30am the next day. The application talks about a reservation deposit on the last page. I sent an email in response stating the differences between a reservation deposit and a security deposit. In the email I attached a copy of the receipt for the bank deposit I made and it clearly states \\\"security deposit.\\\" I also cited Arkansas State Property Codes and I received no response whatsoever. Security deposits are 100% refundable under Arkansas law. If a landlord is unlawfully withholding property, if taken to court, the plaintiff is entitled to double the amount of property being withheld and applicable court costs.
