COMPLAINT DETAILS (from renter)

I have served Rockhill Gallery Apartments with a 30 day notice stating intent to terminate my lease with them. Rockhill Gallery staff has not complied with the 30 day notice clause that is in afore mentioned lease. I wish to terminate said lease because I feel unsafe living on the Rockhill Gallery Apartments premises. My keys have been lost by apartment staff -the locks were not changed until almost two weeks later. Confirmation of this occurance was made the leasing agent who informed me of the incident. Maintenance staff has joked with me about illegal substance use and alcohol use. On top of this unsafeness, I was appalled to hear that maintenance is entering my apartment without notifying me. Also, maintenance requests are taking far too long to be completed. Such as a door which took a month to be repaired; and an outlet which took a month and a half to be installed. They blame this on my dog being out. However, had I known that they were going to be entering my apartment, I gladly would have kenneled him.

Renter May 6, 2008 71.81.249.36 Renter recieved confirmation that future tenant "Nathan" was approved, and signed a one year lease to rent unit 4634 #4 at Rockhill Gallery, beginning June 1, 2008.

Renter May 1, 2008 71.81.249.36 Renter removed all belongings from the property and returned keys to Rockhill Gallery dropbox, along with forwarding mail address, on the evening on April 30, 2008.

Renter Apr 17, 2008 75.169.141.14 Tenant showed apartment to prospective renter on APR 16. Prospective renter picked up apartment application, planning to return it on APR 17 with intent to rent unit 4634 number 4. Prospective renter desires to move in immediately following current tenants vacation of apartment.

It is expected that a portion of tenants deposit goes toward marketing the apartment for rental, and that the tenants apartment will be a priority rental in the building.

Renter Apr 15, 2008 69.76.178.139 It is assumed that both tenant and landlord are actively seeking renters. If by May 5, 2008 a new renter has not been found tenant will pay pro-rated portion of May rent to complete 30 day notice. If by May 10, 2008, when 30 day notice is complete, no renter has been found, tenant will pay the remainder of May rent. Once unit is rented, if before two month time period has expired, tenant will be free and clear of any and all financial obligations to Rockhill Gallery Apartments.

Agent Jun 2, 2008 REQUEST! Amy is requested to contact management about making arrangement to pay for Mays rent.

Agent Jun 2, 2008 CASE UPDATE: Management contacted RPA to confirm that new tenant has movied into rental. However, Amy has not paid for the month of May as agreed upon during mediation. Management is attempting to collect the debt owed by Amy. Management has also noted that failure for Amy to pay for Mays rent as agreed upon will breach the mediation agreement they agreed to.

Agent Apr 28, 2008 Pending confirmation about the tenant being accepted, and the unit being rented.

Agent Apr 28, 2008 Renter contacted agent about a prospective tenant that was approved by management to rent the unit in question. Although approved, management told the tenant that the unit was already rented.

Agent Apr 21, 2008 Management plans to bring other prospective renters through the rental. Amy has also found a couple that may be interested in renting an alternative rental.

Agent Apr 21, 2008 UPDATE: Janet contacted agent about prospective renter "David" that was brought in by Amy. Tenant check was ran but did not pass credit check. Tenant not suitable.

Agent Apr 18, 2008 UPDATE: Tenant has informed Agent that she has advertised and found a perspective tenant that would like to rent unit on May 1st. It is expected that if tenant qualifies for residency, Amy will be released of lease obligations.

Agent Apr 15, 2008 MEDIATION AGREEMENT: Mangement agrees to allow renter to terminate lease based on the following: 1- Deposit will be forfeited 2- Tenant will pay until unit is rented, no more than 2 months

Agent Apr 15, 2008 Although not required management agreed to allow the renter to break the lease agreement under the following conditions: 1- Deposit will be forfeited 2- Renter to continue paying rent until the unit is rented. (up until the end of commitment, although unit is expected to rent quickly)

Agent Apr 15, 2008 This Lease Agreement does not provide renter with the option to break the original "1 yr" lease agreement. If a renter breaks their agreement, management reserves the right to collect the remaining rent due (10.5 months)

Agent Apr 15, 2008 Management explained that renter has been in unit for 6 weeks of her 1 yr commitment. The 30 day written notice for termination of lease applies to after the 1 year term has been completed, I.E. the month to month period after the end of the lease agreement.
