COMPLAINT DETAILS (from renter)

i)On 5/11/08 I informed my lease office about our intent to terminate lease on Oct15,2008. ii)In my response we were given 3 choices verbally , a) $350 for extension b)no fee extend for 6 months c) give notice for 6/9/08 and pay short notice penalty iii) On 5/16/08, in response to this I gave a written letter mentioning our intent to leave on Oct 15. I asked for a waiver since I had plans to leave the country iv) I was told the response might be negative by my manager but she told I would receive a call from Frank, a higher up in the management to discuss this matter. v) I never received a call from Frank, so I went to the lease office to told them since we didnt receive a call from Frank. we are willing to pay the penalty of $350. We were told by our lease office manager that we have to pay the penalty amount with the last month lease. vi) Now when I went to pay our sept rent on aug 30, I tried to verify that all was good and we were shocked to hear my lease office telling us that our previous notice was void because we did not pay the $350 before , when actually we were instructed to pay this with my last month payment. vii) Now we are told that notice will be considered as a short term notice and we will have to pay a penalty for the whole month rent of $935. This I think is unfair and despite all our initial negotiations and timely planning. Kumaran is the lease holder and since he was away he asked me to speak with the lease office.

Renter Sep 9, 2008 72.92.113.164 Thanks Agent. First regarding the breach of contract. Today the lease holder(LH) and I went to the office to explain to the manager that the official LH was traveling and hence I was talking with the company. This should clarify that there is no breach of contact since he is around. After the choices were given i gave a letter stating I will leave on Oct15 but only asked to reconsider the penalty, the letter was accepted then but now they change the stand saying the LH should have given it.

Agent Sep 22, 2008 FINAL RESULTS: After failing to get a response from upper management, Agent Paxton contacted the property manager. They have confirmed that they are unwilling to waive any fees and feel they are in the right to continue forward as a broken lease. Management will not re-consider fees.

Agent Sep 19, 2008 UPDATE: Upper management was contacted earlier this week. They have not yet responded to our request. Agent will attempt again this coming week...

Agent Sep 16, 2008 DOCUMENTATION PROVIDED: Tenant has provided the agent with copies of the letters that were sent to management. Management clearly agreed to allow tenant to terminate agreement on the 15th of OCT. Agent has contacted upper management to discuss the case. Pending Response...

Agent Sep 9, 2008 TENANT CALL: Agent left a message for the tenant explaining the situation. Management is not willing to negotiate or waive fees.

Agent Sep 9, 2008 MANAGEMENT CONTACTED: Agent spoke with Joan concerning the case. Management claims that the options listed below were offered to the tenant in May, however, since the tenant failed to pay the fee or to provide a written acceptance of the terms-- the offer was null and void. Management is not willing to waive or accept the previously discussed charges, since the tenant never provided a written confirmation.
