COMPLAINT :
Fair Resolution according to renter :
  1. Refund of $300. $200 would cover, the final water bill, small damages, and unintentionally missed cleaning (oven and behind refrigerator).

COMPLAINT DETAILS (from renter)

- Provided more than 30 days notice of departure with move date of July 1st, 2009 - Received letter to indicate that July 1st could not be honored due to lease (which Bigelow and I never had a lease agreement, prior mgmt did). - Called Bigelow to compromise on move-out date, which was told that another person had already been given my apartment. Told Bigelow at that time, that I've been occupied their for 4 years, went through 3 or more management agencies, and that the turnaround in the apartment would not be normal of a renter that had been there for a year. - Told Bigelow that I would be out by midnight on June 31st, since that was the only compromise that they would give me. - Morning of move, Jill Oleman told my husband James to call her in the morning to arrange a time to meet to give the keys - We stayed until midnight cleaning the apartment with family that helped - The next morning, my husband (James) called Jill for the walkout and she mentioned she was already there and marked him as absent, she indicated a time was arranged, when clearly it wasn't. - Jill kept looking at the clean apartment, and saying it was dirty. My husband (James) tried to talk to her, but she was upset that someone was moving that day. She alloted no turnaround time for the apartment. - Called Bigelow the day of the move and expressed concern for the attitude of Jill Oleman and concern on not getting security deposit. - After 21 days, received $15 from security deposit in the mail.

Renter Sep 1, 2009 70.92.91.18 Not true. In our conversation no paint was mentioned until the last moment when James Tucker indicated that he painted the wall back white from being blue. There was no shadowing from the paint or the undercolor on those walls. What was mentioned on the call was that there was a small area (less than 2ft radius) that had candle shadowing - very light - which was washable, and required no painting. Basically normal wear/tear. Therefore, we do not feel that we should be charged for the painting.

Landlord Aug 31, 2009 69.129.29.71 Mrs. Tucker stated to me in our first conversation regarding this matter that she DID agree that there was blue shadowing left on the walls upon her departure from the residence. My final offer to resolve this situation is an additional refund of $145 and a copy of the water bill.

Renter Aug 20, 2009 70.92.91.18 We also would like a final copy of the water bill. We received a written statement with amounts, but no documentation.

Renter Aug 20, 2009 70.92.91.18 Update/revision...We believe a fair resolution to this matter would be an additional $185 given the fact that $15.62 was already sent.

Renter Aug 20, 2009 70.92.91.18 We have 3 witnesses that can state that no blue paint was showing or shadowing when we left. We painted the house in the paint requested by onsite manager, we have receipt to prove the color was correct. Again, we lived there for 4 years, went through 3 management companies, and the companies changed the paint in between and we never got a touchup/update on our walls within that timeframe. We believe a fair resolution to this matter is $200.

Landlord Aug 12, 2009 69.129.29.71 Appropriate 30 day notice was given to vacate the apt. on 6/30/09, so the unit was re-rented for 7/1/09, when Mrs. Tucker called at the end of June to extend, we could not allow this as someone else was moving in that day. The apartment was painted a dark blue by the resident, and was still very dark shadowed when returned to us, therefore needed to be repainted. Also, final water bill was $139.39. I would be willing to return an additional $130 of deposit to resolve/end this situation.
