I arrived home at 5:30pm on 8/28/09 to find sewage water in the kitchen sink, dishwasher, cabinets, floor, and carpet. I immediately called my resident manager, Donnie, who was not available. I called Fercho Management and left information on their voicemail. At 7:09pm Donnie called. I explained what was happening. A plumber came to fix the problem, later the water was extracted from carpet. I continued to reiterate to Donnie and that I felt that the entire carpet should be cleaned. On 8/29/09 at 11am, I went to my apartment to check out how things were going. When I walked in there was a strong odor. There were not any fans running to dry the carpet. Donnie said that the carpet had been cleaned the night before, which it wasn't. I called Fercho Management and left a voicemail. I went to the apartment at 8pm, and I contacted Donnie and explained that there was a strong odor. At 9pm, Serve Pro came and ripped up the carpet, sprayed sanitizer, stapled the carpet back down, and put two industrial fans. I was asked to leave the air conditioner on. I received a message from Fercho on 8/31/09. I went to my apartment on 8/31/09, and the fans had been removed. I called Fercho on 9/1/09 and spoke with Lavina. She said that the carpet would be in "either this week or next week". I requested a reduction in rent, as have not been able to stay in my home. Lavina said that "there was nothing wrong with my apartment" and would not receive a rent reduction.

Renter Sep 17, 2009 I will submit the Xcel energy bill as requested by Fercho Property Management. I will consider this case resolved when I have received the $65.00 as promised in this agreement.

Landlord Sep 14, 2009 We have decided that we will reimburse Ms. Holte for the two (2) days of running the fans in her unit; however, Ms. Holte is responsible for providing the verification of energy costs (bill) by Xcel energy. We will also reimburse Ms. Holte $65.00 for the carpet cleaning; since Serv-Pro was in there on the day of the incident to extract water, clean, sanitize and dry the affected area.
