On 4/10/11 we came to Island Shores apartment looking for a rental place, me Diannys Martinez and my husband Abdel Martinez were given information about the fees and the apartment conditions. We were shown a model of the apartment that we were going to rent, ( which was NOT the actual apartment ) it looked good. Raul Erazo the leasing sales person asked us for our information and rental requirements to be met, which we immediately provided. After that we asked several times to go and see the actual apartment that we were going to move into, to which he always gave me an excuse for us not to see it. He said we could not see the apartment because they were cleaning it ( when we moved was still extremely dirty and we have proof of it ), fixing all the issues, painting it, fixing the AC unit ( which is still is not working properly ). The day we moved 4/30/11 we still had not seen the apartment, we actually saw it the same day we were given the keys.
The same day when we were given the keys ( still with no furniture inside or any of our belongings inside the apartment ) we went inside to see it and my daughter laid on the floor for more or less 10-15 minutes and she got up because she had bites all over her body ( We have pictures ). Immediately we reported the incident to the office so that they can spray and search the apartment for bugs, the did not preformed a thorough search for bugs or any other kind ( we know this because my husband was there at the time when they came to our house to spray it ) although they did sprayed it. The results were worthless. We had to keep calling over and over again reporting the same issue but nothing, sometimes we had to wait a week for them to do it. Three weeks ago we called again for bug issues and this time they did investigate a little more and they said we have bed bugs. They are saying we are responsible for it and that we will be evicted if we do not pay for the fees. We came to agreement that we were going to pay $ 125 and they another $125 for the total of $ 250 for one treatment. Did not work at all now it is even worst, they only sprayed. This apartment is in inhabitable and infested by bed bugs that can be in breach of the implied habitability warranty which requires landlords to provide a safe livable unit.

LANDLORD REFUSAL: Despite repeated attempts both written and verbal, the Landlord/ Manager has refused to respond to the complaint. Due to the landlords refusal to cooperate with RPA Mediation, the RPA has no choice but to close this case. The tenant will need to seek other legal options such as court. |
