COMPLAINT DETAILS (from renter)

Upon viewing the house i rented from my landlord, i explained that my sister and her medium sized dog would be staying with me for a few months. Ann said no problem, and just keep me posted on when she leaves, etc. I put my sister on the lease as "other occupants" as well as the dog. When i received the copy of lease from Ann 3 months after i signed, my sister and the dog were erased. On 3/1/13 - Ann accused me of housing a "dangerous dog" - and through much fighting and me having to hire an attorney and pay attorney fees, Ann decided to evict my sister and her dog. I have had continuous issues and harassment from Ann since this day. She has called me, yelling, hanging up on me, repeatedly threatening me of eviction if i don't comply with every demand she places. I paid March rent with a personal check, as i always have, and Ann decided to go to my personal bank to cash it, and with their policy, any check over $500 they have to call the member to verify, which they did. I approved the check, then received a call from Ann, YELLING at me that my check bounced, which was not the case. The bank tellers were even shocked by her demeanor and lack of respect. She ultimately cashed the check. Then emails me that cash or money orders are only accepted from now on. There are many more details to this which I will add later. April 1st comes, I go to my bank to get a money order, which they provide me. I put it in Ann's mailbox as instructed, and she emails me 6+ hours later with a horrible email, bashing my character and harassing me, telling me the money order i provided is NOT a money order. I emailed her back stating i was leaving work to go pick up my money order, to replace it with cash. I showed up to her house "while video taping everything from my phone" and asked for my check back, she refused to give it to me, and slammed the door in my face. she was holding my money ransom, and stated that she "wanted rent" but would NOT accept the money order she had. So, I called Travis County Sheriffs Department to come assist. They could not make her give me back my money, ultimately having to file a police report which i have on file. I had a friend of mine meet her in exchange for the money for the money order. She signed a receipt from my friend, but i refuse to see her in person without a witness. i want her to leave me alone, or let me out of my lease with no penalty and my deposits returned. she should not be able to rent homes to anyone!

Of course I did not receive any confirmation that she received it. I have a copy of this form, in email - that my attorney has as well.

Renter Apr 18, 2013 209.253.216.2 Ann Finch is lying. She is lying about everything she listed in the previous response. I have proof of everything she is claiming, which otherwise shows differently. I find it entertaining that Ann Finch claims I AM the one harassing her. I have more than enough proof and instances that SHE is in fact the one causing mental anguish. My sister and her dog were NOT UNauthorized. Ann Finch knew about them staying there, and I have proof of this as well, (copy of credit app, and lease, as well as emails) acknowledging this. I hired an attorney for assistance because Ann Finch was charging me unnecessary fees and tacking on unrealistic fees, which I then had to have assistance on. She was threatening to evict me if I didn't pay these fictitious and "made up" charges. I was NEVER LATE on my rent, not once. I have cashed checks, carbon copies, and EMAILS showing as proof of when I paid her rent as well. As stated in the last email to Ann Finch, I will have to call the Travis County Sheriffs Office on May 1st to accompany me to Ann Finchs residence to act as a witness, in fulfilling the lease obligation of paying rent. And again, there is NO reason why she is demanding cash, besides to make my life difficult. It it beyond me why Ann Finch will not grant me a release of lease without penalty if she feels as if i am a bad tenant. If she claims she is having so many issues with me, let me out. I will gladly go. Ann Finch should not be allowed to rent property at all. I have spoken to others that know her, and everyone states the same. I will upload everything (proof) pertaining to her accusations so they are documented. As for the yard, I have maintained everything - and again, this is one more thing Ann Finch is harassing me with now. Ann - I want out of your house, and away from you professionally and personally. You are a horrible person, and I will make it known that you are not releasing me from this lease due to landlord / tenant differences, and I will take this further if need be. I want you to grand me a release of lease, withOUT penalty, and my 2 months deposit returned. It is evident that you will NOT leave me alone, and I am done with your accusations, lying, harassment, threats, and over the top horrible property ownership. Let me out or I have prepared to take you to court.

Renter Apr 7, 2013 70.112.16.150 1.I believe Ann Finch will do anything she can to keep all of my 2 months deposit she demanded to allow me to move in. She has already blamed previous issues on me, while they are listed on my inventory sheet - she has NOT signed off on still - 4 months later.

Renter Apr 6, 2013 166.137.156.158 1.Ann Finch also did not do a walk through with me upon moving in on January 1st, 2013. She also has not confirmed my move in inventory sheet which placed in her mailbox on Jan 3rd 2013.

The RPA has made beyond reasonable efforts to work with the Landlord / Manger to find a resolution to the complaint. Management has refused all reasonable measures to resolve this complaint. Due to the unwillingness from management , the RPA has no choice but to close this case with a negative disposition. Case Closed.
