This is a security deposit “demand” letter. Unfortunately, I was not happy with my returned deposit of 145.09 that you issued me on Dec.13, 2013 after my son Paul Carter was requested to move out per your written request of immediate eviction which was placed on my son’s door apt. 21 on 11/19/2013. After our conversion on 11/18/2013 we discussed a friendly move out process by me which we agreed upon to be weekend of Nov. 23/24. You left the door unlocked so I could remove his items. That effort was done and we left the apartment as clean as when he entered on September 12, 2013. I returned the keys to you on Nov. 26, 2013 and we briefly spoke about the return of the security deposit. During the rental agreement process you requested 3 months of upfront rent at $375.00 per month as well as a $500.00 security deposit due to his criminal record and not having a job. I issued you $1625.00 check and he signed a month to month agreement. Payment received for the period of 9/12/2013 through 12/12/2013. You held back approx. $100.00 for cleaning fee, $25.00 for lock exchange, and $199.00 for lawyer fee. End result was you issued me 149.09. I requested a return for the 16 days of rent we had prepaid upfront per your request. I returned keys to you on 11/26/2013. Rent was paid up to 12/12/2013. This is 16 days of rent that should have been returned for the amount of $200.00. The law requires you return this money as it was not forfeited for non-payment of any kind. Eviction is the request of a landlord to move from the occupied area. We pleasantly did so without court issued papers and in friendly manner. In addition you did not return my security deposit in the allowed time period of 14 days per Arizona State law. Key turn over date was 11/26/2013. Security deposit return was issued to me on Dec. 13, 2013. Which is 17 days. I tried contacting you 3 times on your phone 519-9283 to retrieve my deposit back. On 11/26/13, 12/6/2013, and 12/11/13. The law entitles me to at least $200.00 of returned rent. If I do not receive this money by Dec 31, 2013. I will need to pursue a small claims with assistance from my lawyer.
